1       ABOUT THESE TERMS AND CONDITIONS

  • You should read the terms and conditions set out below before purchasing goods using this website.
  • These terms and conditions apply to the purchase of products on this website. In using this website for this purpose, you agree to be bound by these terms and conditions. If you do not understand or accept these terms and conditions, you must refrain from purchasing products using the website. These terms and conditions must be read in conjunction with any other applicable terms and conditions governing the use of this website, including the Privacy & Security Policy and Refund Policy.
  • In these terms and conditions, the expressions “we”, “us” and “our” are a reference to Victorian Designer Floors. The term "you" relates to the customer/consumer.

 

2        ORDERING PROCEDURE

  • You may offer to purchase products described in this website for the price specified on this website.
  • Your order must contain your name, postal address, phone number, e-mail address, credit card details and any other ordering information specified on this website.
  • Confirmation of your purchase will be sent to your e-mail address once your payment has been cleared. If you do not receive a confirmation e-mail within two business days please contact [email protected]
  • The goods are offered for sale only to persons who can make legally binding contracts.
  • You are responsible for checking that the details of any quotation generated by us, is complete, accurate and meet your requirements before committing yourself to an order.

 

3        YOUR ORDER

  • Acknowledgement of your order is not a guarantee by us of the availability of the products.
  • If you have provided your own measurements, you are responsible for these being accurate and Victorian Designer Floors accepts no liability if not enough material has been ordered. Therefore, please make sure that these are correct at the time of ordering to avoid any issues upon delivery or during the installation process.

 

4        PAYMENT

  • We must receive payment in advance before your order and/or purchase can be processed.
  • Online payments may be made by debit or credit card. Payment using a debit or credit card is taken at the time you place your order and is processed using an independent company’s secure payment processing system. We do not see, or have access to, any of your payment card information.

 

5        PRICE-MATCH GUARANTEE

Victorian Designer Floors offers a 'price-match guarantee' service on the identical product(s) and quantity for retail clients only. To make sure we are comparing the same products, we require a formal valid written quotation. Prices must be issued within the past 30 days and not on sale.

We only price match against retailers who are based in Australia and sell direct to customers

 

How do I request a price match?

Call our sales team on 03 9439 1823 or email us on [email protected] with the details of the competitors advertised price for the identical product.

Once your price match request is verified and the competitor’s product is confirmed as being in stock and available for immediate sale we will happily match the price.

 

Price match conditions:

  • We must be able to verify the competitor's price, and stock availability.
  • The competitor product is brand new, identical and offered on the same terms.
  • The product must be available for purchase by a retailer operating in Australia, either in a store or online.
  • Offer only applies to products, not services.
  • Cannot be used with any other offer.

 

Price match exclusions:

  • Pricing with included delivery or installation.
  • Clearance, sale or discontinued products.
  • Products with pricing set significantly lower than the recommended retail price or market value.

 

6        WEBSITE IMAGES

  • Colour representation of the product images is not guaranteed, we always recommend ordering a sample or visiting our showroom to see the product for yourself.
  • All images and content displayed on our website is represented as near as possible to the product we are describing, it is to be used as a guide only, as images on screens can vary depending on screen contrasts and brightness. If you are in any doubt about the colour you see online, we urge you to order a sample prior to placing an ordering, to make certain the colour meets your requirements.

 

7        COLOUR VARIATION

  • Colour variation in timber flooring is a natural occurrence and should be expected. Variations can be due to species, age, growing conditions, character of flooring, and exposure to UV light or sunlight. For these reasons flooring may not always match samples and/or existing flooring.
  • Natural characteristics will vary based on the grade chosen in the solid hardwood timber range

 

8        SAMPLE SERVICE

  • Our samples are taken at random from our current stock allowing us to offer a true representation. We don’t change or enhance the samples to give any false reflection.
  • Samples won’t be identical as natural products offer natural variation, which adds to the beauty of the goods.
  • Sample sizes may vary however we try sending them as big as possible, to give the customer a more accurate resemblance.

 

 

9        CANCELLATION DUE TO ERROR OR UNAVAILABILITY 

  • You acknowledge that despite our reasonable precautions, products may be listed at an incorrect price, with incorrect information, or which are unavailable due to a typographical error or like oversight. In these circumstances, we reserve the right to cancel the transaction, notwithstanding that your order has been confirmed and your credit card has been charged. We reserve this right up until the time of delivery of goods.
  • If a cancellation of this nature occurs after your credit card has been charged for the purchase, we will immediately issue a credit to your credit card account for the amount in question without deduction.
  • All products are subject to availability. If you order products which are not available in stock, we will take reasonable steps to contact you to discuss how you wish to proceed. You will have the option to wait until the products are available in stock or cancel your order. If the products are unlikely to be restocked (or we are unable to contact you), we will cancel your order for those products and refund the price you have paid for those products.

 

10    DELIVERY

  • Delivery conditions: No claim will be recognised after 14 days of delivery.
  • Crane unload from road to maximum reach of boom within safety.
  • Carrying timber indoors - Due to the nature of this work there may be occasions where scuff marks or dents may occur on the walls. Victorian Designer Floors takes no responsibility for this.
  • It is the customer’s responsibility to store material indoors unless specified.
  • A fee of $99.00 Inc. GST per hour will apply if the above delivery instructions are not adhered to. The invoice will be forwarded to the customer to be paid within 7 days.
  • Delivery of the products will be effected in the manner described on this website. I.e. Items purchased online will (subject to availability) be despatched by courier as soon as practicable after receiving your order.
  • No liability can be accepted for costs caused by late deliveries or for any other reason. We advise against booking trades for installations until goods have been received.
  • Please ensure that you inspect your goods prior to installation and that the goods are correct as per your order and that you are happy with the appearance and quality. Once the installation has started no claims for incorrect goods will be accepted.
  • If a courier arrives at your address and is unable to deliver on the arranged delivery date because you are not there, refuse to sign or you refuse delivery you will be liable for the cost of any re-delivery charge when applicable. Goods will not be left unattended.
  • Goods will only be despatched upon receiving payment.
  • Option to pick up order from our warehouse located 18 Freight Drive, Somerton. Operating hours 7:30am – 3:30pm, Monday to Friday. Closed weekends and public holidays.
  • Situation’s that require a change of address, please allow enough time as possible. Once the order has been despatched the address cannot be changed.
  • Free Delivery will be provided to all orders over $4,000 and within a metro Melbourne radius. Regional and country Victoria will incur additional costs.
  • Delivery timeframe is dependent on stock availability.

 

11    ONSITE WORKS

  • When choosing on site services completed by Victorian Designer Floors is subject to site measure and assessment. No works will commence until site is inspected.
  • Onsite services is only offered in Victoria.
  • Victorian Designer Floors will arrange for qualified trades to complete works provided always that you have requested this service and the same is include in the written quotation.
  •  Delivery is included in the full package of labour and onsite services.
  • In the event that measurements are provided by you to us you are responsible for the accuracy of such measurement.
  • Due to the nature of these services exact arrival and completion times cannot be guaranteed,in the event there are delays and we cannot be held responsible for these delays in carrying out this installation. Please allow sufficient time for works to be completed.

 

12    REFUNDS/REPLACEMENT

  • Under certain conditions, refunds are available for unopened items valid up to 14 days after the date of purchase. Returned goods must be complete, unused, and in “as new" condition.
  • Return product purchase to our warehouse located at 18 Freight Drive, Somerton VIC 3062
  • Admin & restocking fees 30% will be applied to all timber flooring items.
  • Admin & restocking fees 50% will be applied to all accessories.
  • No return of hardwood timber flooring.
  • No return of specially ordered timber flooring.
  • No return of internationally sold items.
  • We undertake to comply with the terms of our refund policy in relation to the refund of replacement products to our consumers.
  • No returns/refunds on products sold as ‘Clearance’, products with a ‘Sale’ price or products sold as ‘discontinued’
  • No returns/refunds on products that are considered ‘Special Order’ or that are not stocked in at Victorian Designer Floors warehouse.
  • When returning or cancelling your order, the way you originally paid for the purchase will determine how you are refunded.
  • If you paid by credit or debit card, we’ll refund the same card originally used to place and pay for the order. If you return your item directly to one of our stores, please make sure you take with you the card that you used to make the purchase.
  • Refunds can take up to 14 days to process.

 

CHANGE OF MIND

  • If your order has been dispatched or delivered, however you no longer need it, we’re happy to accept this back. Our 14 day returns guarantee means you can return your order within 14 days from the date of delivery.
  • If you’d like to arrange a return, please make sure you have the following information to hand so we can deal with your query as quickly as possible:
    • Your invoice number (this can be found on your order confirmation email)
    • Your contact details
    • PLEASE NOTE: You are responsible for returning the goods to us at your expense; original delivery cost is non-refundable.Once received, your refund will be with you within 14 days.

ORDER ARRIVING DAMAGED

  • In the unlikely event your order arrives damaged, please accept the delivery and sign for the goods as damaged. At your earliest convenience, please get in touch with our team to arrange a suitable replacement or to request a refund.
  • If you notice a problem after signing for delivery, then please contact us at the earliest opportunity to arrange a replacement or refund and we’ll have this arranged for you. We do advise you check your packs upon arrival to avoid unnecessary delays with your project.
  • If you’d like to arrange a return, please make sure you have the following information to hand so we can deal with your query as quickly as possible:
    • Your invoice number (this can be found on your order confirmation email)
    • Your contact details
    • Photos or videos of the damage/fault
    • Please note: You’ll be required to provide evidence of the fault before your replacement or refund can be processed
    • A replacement will be sent out to you at the earliest available delivery date. If you’ve requested a refund, this will be processed within 14 days.

 

13    SECURITY

  • Unfortunately, no data transmission over the internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Accordingly, any information which you transmit to us, including your credit card details, is transmitted at your own risk.
  • Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of such information.

 

14    PRIVACY

  • We undertake to comply with the terms of our Privacy Policy in relation to the collection and use of your personal information.

 

15    DISCLAIMER & LIMITATION OF LIABILITY

  • To the extent permitted by law, we exclude all liability arising from or relating to your use of this website including the online purchase of Victorian Designer Floors products, as set out in our Legal Disclaimer.
  • Details contained on this website relating to goods and services have been prepared in accordance with Australian law and may not satisfy the laws of any other country. We do not warrant that the details on this website concerning those goods or services will satisfy the laws of any other country. It is your responsibility to determine whether these details satisfy the laws of the jurisdiction in which you reside (if that jurisdiction is outside Australia) and if the details do not satisfy the laws of your jurisdiction, you may not order any goods or services from this website.

 

16    CHANGES TO THESE TERMS AND CONDITIONS

  • We reserve the right to amend these terms and conditions from time to time. Amendments will be effective immediately upon notification on this website. Your continued use of the website following such notification will represent an agreement by you to be bound by the terms and conditions as amended.

 

17    TERMINATION OF ACCESS

  • Access to this website may be terminated at any time by us without notice. Our disclaimer will nevertheless survive any such termination.

 

18    GOVERNING LAW

  • These terms and conditions are governed by the laws in force in Victoria. You agree to submit to the jurisdiction of the courts of Victoria.

 

19    GENERAL

  • We accept no liability for any failure to comply with these terms and conditions where such failure is due to circumstances beyond our reasonable control.
  • If we waive any rights available to us under these terms and conditions on one occasion, this does not means that those rights will automatically be waived on any other occasion.
  • If any of these terms and conditions are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions shall nevertheless continue in full force.

20    INDEMNITY

  • You agree to indemnify us against any claims, losses, liabilities, damages and expenses (including legal fees), arising out of your use of this site.

 

 

 

Australian Consumer Law

By law we are required to state:

"Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure."

Notwithstanding the above, there may be circumstances pursuant to the Australian Consumer Law where you are not entitled to such a return or replacement of goods and in such circumstances, Victorian Designer Floors does not guarantee or warrant any such right. For example, the right under the Australian Consumer Law does not apply to return of goods where damage occurred after installation for reasons not related to the condition of the goods at the time of supply or when attached to any property such as a house or unit that cannot be detached without damage.

Refund, Credit or Exchange

If the product does not match its advertised description, Victorian Designer Floors will provide you with a choice between a credit to the value of the item purchased or an exchange. However, we note that items on the Site may appear differently on screen than it appears in real life. This may be caused by your screen settings or the settings that were used in the production of the original image. Colours and texture are often difficult to see and judge online with 100% accuracy.

For our laminate products, our manufacturers make every effort to match dye lots, however, customers are also warned that colour shades and variations may appear in the product (including, but not limited to, when the product is exposed to UV light). As timber, oak and bamboo are natural products their colour, grain, shade and texture will vary from board to board and will be different to the sample.

Where there is no fault found requiring refund, credit or exchange by us, the product will be returned to you at your cost. We may need to consult with the manufacturer to determine the fault and resolution. Where the manufacturer assessment finds that there is no fault with the goods, or that the goods have been damaged due to misuse or abnormal use of the goods by you, we may require, at our discretion that you compensate us for any fee imposed on us by the manufacturer or freight cost in relation to this assessment.

Unfortunately, Victorian Designer Floors cannot offer a refund, credit or exchange where the damage occurred after installation for reasons not related to the condition of the goods at the time of supply including, but not limited to, where the product has sustained damage due to any wilful or accidental damage to the product, abnormal use (whether or not such use has been identified by Victorian Designer Floors  or the manufacturer), damage arising from furniture standing or being moved on the product, damage arising from unusually heavy wear of the product (including, but not limited to, damage caused by stiletto heels, castor chairs or any metal or hard ends of furniture) or damage caused by water either through spillage, flooding or moisture penetration through the subfloor.
